Thank your for your interest in THE TALK Magazine.

If you wish to receive THE TALK Magazine via subscription , please send a cheque for the amount of £15 GB sterling , made payable to THE TALK Magazine, along with your commencement issue, complete name, email address and mailing address to:

01.             CONTRACTING PARTY

Your subscription contract will be fulfilled by THE TALK Magazine.

02.       THE SUBSCRIPTION CONTRACT

The subscription period lasts 12 months from the date on which the order commences.

When you take up subscription with THE TALK Magazine , we will send you an e-mail confirming receipt of your order. Your order represents an offer to us to purchase a product which is accepted by us when your payment is processed .

When you submit your order, you are making an offer to take out a subscription which , if accepted by us, will result in a binding contract. This legally binding contract is formed on the date we send you written confirmation of your order and a receipted invoice.

We will not be responsible if you fail to receive the written confirmation because you have supplied us with an incorrect postal address.

03.       RIGHT TO REFUSE ORDERS

We reserve the right to refuse orders on application at our discretion.

04.       DELIVERY

Magazines are sent directly to the Subscriber's address by Regular Mail, postage paid by THE TALK Magazine, by the beginning of every month.

We will deliver the magazines to the address you notify to us when you place your order. W e will not be responsible for failure to deliver the magazines if you have supplied us with an incorrect address.

Subscription prices shown on our website are delivery to addresses inside the United Kingdom. Deliveries to European countries or beyond are more expensive, but can usually be arranged on special request. Apply for a tariff.

05.       DELAY IN DELIVERY AND NON-DELIVERY

We will not be liable to you for any delay in delivery or non-delivery of magazines where such delay or failure is due to circumstances beyond our control, including but not restricted to : war, electricity power failure, utilities failure, failure of telecommunications links, failure of transport infrastructure, fire, flood, government act, act of God, legislative constraints, strikes, labour disputes or malicious damage involving employees.

Subscribers can report undelivered or damaged issues to THE TALK Magazine. Complaints about undelivered issues must be made immediately upon noticing gaps in the numbering sequence. Complaints about damaged issues must be made no later than 3 days after the delivery date and the damaged issue returned to THE TALK Magazine.

THE TALK Magazine supplements undelivered issues and replaces damaged issues. Should a complaint remain uncorrected, THE TALK Magazine will extend subscription by the applicable number of issues.

06.             CANCELLATIONS AND REFUNDS

You may cancel your subscription contract at any time during the subscription term. The instruction to discontinue subscription must be effected in writing. No refunds can be made.

07.       PRICE INFORMATION

Prices displayed on the subscriptions section of the magazine and website will prevail at all times. Although we try to ensure that all prices are accurate, errors may occur. If we discover an error in the price of your order, we will inform you as soon as possible. You will have the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you, we will treat the order as cancelled. We will refund you in full if you cancel the order and have already paid.

We guarantee fixed prices throughout the subscription period.

08.             LIABILITY

Our liability to you for breaking any of these Terms and Conditions is limited to refunding any money you've already paid for subscriptions that you haven't received. Our liability excludes situations where performance of any obligations to you is prevented, frustrated or impeded by any circumstance or caused beyond our reasonable control. So far as the law allows, we will not be liable for any further loss or damages.

These Terms and Conditions do not and shall not affect your statutory rights as a consumer.

09.             PERSONAL INFORMATION

We will only use the personal information you supply to us in order to fulfil your subscription order.

10.             VARIATION

We may change these Terms and Conditions at any time upon giving you 10 days prior written notice .

11.       We may from time to time, with your permission, send you details of Arts related ancillary offers from our sponsors or partners.

12.       PRIZE DRAW AND COMPETITIONS

All prize draws and competitions which are associated with THE TALK Magazine subscription offers are subject to separate terms and conditions.

13.       GIFT SUBSCRIPTIONS

Once you've placed your gift order and payment has cleared , you'll receive a postal acknowledgement and receipted invoice . A gift card will be sent to you to pass on to the gift recipient.

14.             RENEWING

We notify all customers of the upcoming subscription expiry date and will offer them the chance to renew at the price at that time.

15.             SEVERABILITY

If any part of these terms and conditions is found to be unenforceable as a matter of law, the enforceability of any other part of these terms and conditions will not be affected.

16.       RE- ORDERING ARCHIVE COPIES of THE TALK Magazine.

Copies of issues other than those which are published within the subscribing term are to be considered archive copies. The prices of such copies will be higher than those applied in subscription. Conditions applicable to current subscriptions apply also to orders for archive copies.

17.             GOVERNING LAW AND JURISDICTION

These Terms and Conditions are governed by English law. You hereby irrevocably submit to the exclusive jurisdiction of the English courts notwithstanding the jurisdiction where you are based. These terms and conditions are governed by and construed in accordance with the laws of England and Wales. The English Courts shall have jurisdiction over any disputes between us.

Q UERIES

If any of these conditions are unacceptable to a current subscriber, they should contact THE TALK Magazine immediately. We will make every effort to resolve any concerns to allow continued access to THE TALK Magazine, but may, in exceptional circumstances, allow the subscription to be cancelled and refunded.
